Unpaid Wages & Minimum Wage Violations

All workers—regardless of their immigration status—are entitled to be compensated for the work they do.  They must be paid at least a lawful minimum wage under both federal and state law.  Most importantly these laws protect workers and guarantee them the minimum wage, even if a worker agreed to be paid less than the minimum wage.  Unfortunately, frequently employers violate these laws by refusing to pay a worker what he/she is owed.  I have worked tirelessly to recover money from these employers and will make sure you are properly paid for your work.

Overtime Violations

With some exceptions, employees who work overtime are entitled to overtime pay of at least one and one-half times their regular rate of pay for each hour worked over 40 hours in any given week.  For most people, this is true no matter what their job title is, how they are paid (e.g. hourly, daily, salary, by commission, by job completed), or what their employer may have told them about overtime.  Just as with the minimum wage, employers must pay the overtime at the minimum of 1.5 times the employee’s regular rate of pay, even if an employee agreed to be paid at a lower rate, e.g., straight time. 

Retaliation

Federal and state law protect employees from retaliation when employees complain—either internally or to an outside body like the Equal Employment Opportunity Commission (EEOC)—about workplace discrimination, harassment, minimum wage, or overtime.  That is true even if the claim turns out to be unfounded, as long as it was made in good faith.  Furthermore, these protections apply regardless of immigration status.  I encourage you to contact me immediately if you are currently experiencing any form of retaliation (e.g. reduced pay, hours) so that I can counsel you regarding the best method for documenting your situation and protecting your legal rights.

Biography

I graduated from Binghamton University with a bachelor’s degree in Economics. I earned my law degree with honors, cum laude, from New York Law School and was the recipient of the Anthony E. Jannace Award for Outstanding Achievement. Prior to and throughout the law school, I worked as a paralegal for a general practice litigation law firm of Mitchell R. Schrage & Associates, PLLC, where I was exposed to all aspects of civil litigation. In 2006 I opened my own private practice, focusing primarily on labor and employment law. In my 15-year legal career, I served as a litigation consultant attorney for several of the largest global law firms, working on significant national and international corruption and compliance matters. In addition, for 9 years I served as “of counsel” and a trial strategist to The Warshawsky Law Firm, a boutique law firm specializing in labor and employment federal litigation. I have experience with federal jury and bench trials and have briefed and argued appeals before the federal and state appellate courts. Most recently I have second-chaired a federal jury trial resulting in a jury verdict, and a total recovery of over $250,000.00, for a sexual harassment victim.
